1. Who we are

The website pasqualejimmy.it is operated by COTTON di Pasquale Divittorio, Via dei Muratori 9, 76121 Barletta (BT), Italy, VAT number IT06794460722.

In the following text we refer to ourselves as "Pasquale Jimmy", "we" or "our", and to you as "customer" or "you".

2. What these terms cover

These terms govern the distance sale of men's knitwear through the website pasqualejimmy.it. By placing an order you confirm that you have read and accepted them.

We may change them at any time. The version that applies to your purchase is the one published on the website when you send your order.

3. The products

All items are our own production, made in Italy. The composition, construction, weight and measurements of each item are stated on its product page.

Knitwear is made on knitting machines and finished by hand: small differences in measurements, within about one centimetre, are normal and are not a defect. Colours may also look slightly different from one screen to another.

4. How the contract is concluded

When you send an order you are making a purchase offer. The contract is concluded when we send you the order confirmation email.

We may refuse an order, with a full refund, if the item is no longer available, if the price or description contained an obvious error, or if we cannot complete the payment.

Check your order before sending it. If you need to correct something, write to us as soon as possible: if the parcel has not yet left, we will make the change.

5. Prices and payment

Prices are shown in the currency of the delivery country. For deliveries within the European Union they include VAT. For deliveries outside the European Union, duties, import taxes and customs fees are paid by the seller: the recipient pays nothing on delivery.

Shipping is free to all destinations.

We accept the payment methods shown at checkout. Payment is made at the time of order.

6. Shipping and delivery

We ship with FedEx. Conditions and times are in the Shipping policy.

Delivery times are indicative and depend on the courier. A delay by the courier does not entitle you to refuse the goods, but if the order does not arrive within the expected time, write to us and we will take care of it.

7. Right of withdrawal

If you buy as a consumer, you have the right to withdraw within 14 days of delivery, without giving any reason, under the Italian Consumer Code (Legislative Decree 206/2005). Within the same period you can ask for a size exchange. The full conditions are in the Refund policy.

8. Legal guarantee of conformity

All items are covered by the 24-month legal guarantee of conformity provided by the Italian Consumer Code for purchases made by a consumer resident in the European Union.

If the item you received is defective or different from the one ordered, write to info@pasqualejimmy.it with your order number and a photo: replacement or refund, including shipping costs, are at our expense.

9. Use of the website

You may use the website to find out about our items and buy them. You may not use it for unlawful purposes, to collect data automatically without our written consent, or to interfere with its operation.

If you open an account, you are responsible for keeping your login details confidential and for all activity carried out with your account.

10. Intellectual property

The name Pasquale Jimmy, the logo, the texts, the photographs and the technical drawings published on the website are our property. They may not be reproduced or used without our written consent.

11. Personal data

The processing of your data is described in the Privacy policy and in the Cookie Policy.

12. Technical platform

The shop is built with Shopify, which provides us with the platform to sell online. The sale takes place directly between you and COTTON di Pasquale Divittorio: Shopify is not a party to the purchase contract and is not responsible for the products.

13. Limitation of liability

We do our best to keep the website always available and the information correct, but we cannot guarantee that it is free of interruptions or errors.

Nothing in these terms limits the rights that the law grants to consumers, including liability for wilful misconduct or gross negligence and the legal guarantee of conformity.

14. Applicable law and disputes

The contract is governed by Italian law. For disputes with consumer customers, the court of the consumer's place of residence or domicile has jurisdiction, if located in Italy.
